What Do I Need To Have a Medical Malpractice Case?

Video transcript:

When we get contacted for a medical malpractice case, some people might think that just because there was some type of negligence or some type of injury, there’s automatically a case. But when we’re looking to see if we can form a medical malpractice case, we have to see whether the outcome changed because of the negligence.

For example, if you’re diagnosed with cancer and you think that there was a delay in diagnosing your cancer, it’s not enough to say, “Okay, there was a three-month delay,” for example. We need to know that the staging of the cancer was different due to the delay in diagnosing it. It’s not enough to say, “Okay, I have cancer and there was a three-month delay, but I’m still stage one.” The difference would have to be, “Okay, there was a three-month delay, and I’m now stage three.” A medical malpractice case can be filed in a situation like that.
