What Happens When OG Law Reviews Your Medical Malpractice Case?

Video transcript:

From the moment you sit down with us to look over a medical malpractice case, the first thing we would do is order the medical records. Once we have the medical records, those are reviewed by the medical malpractice team. And if it looks like there is a case there, we then send it off to an expert in the same specialty as the type of doctor that we are claiming was negligent in your care. From that point, if the expert can say that your doctor deviated from the standard of care, which means they did not do what they were supposed to with your care, then we are able to file a complaint in your case.

Once the complaint is filed, we need to serve the complaint, and then we need to do discovery. Discovery is when both sides answer questions and produce documents. Depositions are question-and-answer sessions led by counsel. It’s their opportunity, or our opportunity, to gain additional information.

Once the depositions are complete, we have experts on the case. So those are the doctors that are in the same specialty as your doctor. And then we would also need a damages expert. A damages expert is somebody to say, “Okay, if there was a delay in diagnosing cancer, here is how the difference in staging went. She would have been stage one, or he would have been stage one, but now they’re stage three because of this delay.” Once we have all of the experts lined up, we can prepare the case for trial.

We prepare every case as if it is going to trial, but sometimes along the line there’s mediation that we could do. We can also talk about settlement between counsel without a mediator. If those are not successful, we prepare the case for trial. The end result would be a trial with a verdict.
